General conditions

GENERAL RENTAL AND BOOKING TERMS AND CONDITIONS

    1. CONTRACTING PARTY AND SCOPE
The lessor and contracting party is K&K Sports GmbH – S.r.l. (hereinafter “K&K Sports”). These terms apply to reservations and rentals of ski, snowboard, cross-country, ski touring, sledding, snowshoe, clothing and other sports and leisure equipment, as well as related additional services.

    2. RESPONSIBILITY OF THE RENTER
The renter is responsible for the rented equipment throughout the entire rental period. The renter undertakes to use the equipment carefully, properly and solely for its intended purpose and to comply with the applicable safety rules.

    3. CONTRACTUAL LIABILITY AGREEMENT FOR BREAKAGE AND THEFT
The rented equipment is not automatically insured. By selecting the optional SportPro Protection Fee, the renter may enter into a contractual liability agreement for breakage and theft. The fee is 10% of the standard rental list price for the relevant equipment and booked rental period, before any discounts are applied. The actual amount payable is shown before the booking is completed. SportPro is optional and must be expressly selected. It is not an insurance policy.

For a covered event, K&K Sports waives all charges for the equipment’s current value and repair costs. Unforeseen damage during proper use and proven theft during the rental period are covered. There is no additional deductible for covered events.

In the event of theft, K&K Sports must be informed without delay and a report must be filed promptly with the competent police authority; section 5 also applies.

Damage caused intentionally or by gross negligence, loss including accidentally leaving equipment behind, unauthorised transfer to third parties and damage resulting from use contrary to the intended purpose or clearly improper use are not covered.

    4. LOSS, THEFT OR TOTAL LOSS WITHOUT LIABILITY AGREEMENT
If there is no liability agreement, or if the event is excluded from it, the renter is liable for loss, theft or total loss subject to the applicable statutory requirements and only for the actual loss incurred. The relevant amount is the equipment’s current value, reasonably determined by reference to its age, condition and replacement value. The amount charged will not exceed 50% of the manufacturer’s recommended retail price for that model; if the model is no longer offered, the last published recommended retail price for that model applies. K&K Sports will explain the calculation on request. The renter may show that no loss or a substantially smaller loss was incurred.

    5. POLICE REPORT IN CASE OF THEFT
In the event of theft, the renter must immediately file a report with the competent local police authority and provide K&K Sports with a copy. The liability agreement applies to theft only if the theft is reported promptly and K&K Sports is informed without delay.

    6. DAMAGE AND NORMAL WEAR
Damage caused by improper use, negligence or use contrary to the intended purpose and not covered by a liability agreement will be charged according to the documented repair costs. Normal wear and tear resulting from proper use will not be charged.

    7. DELIVERY SERVICE AND FITTING
When using the delivery service, the rented equipment must first be fitted at a K&K Sports rental shop. After fitting, the equipment will be delivered free of charge to the stated accommodation on the Seiser Alm and collected again at the end of the rental period. Changes to an agreed collection time must be communicated in good time. The delivery service is available exclusively for accommodation on the Seiser Alm.

    8. EXCHANGE DURING THE RENTAL PERIOD
The rented equipment may be exchanged for an equivalent item during the rental period, subject to availability. An upgrade to a higher category is possible upon payment of the applicable surcharge. No refund of the price difference is due when changing to a lower-priced category.

    9. PAYMENT, COLLECTION, LOCKERS AND RETURN
The price, any discounts and additional charges, and the payment date are shown before booking and recorded in the booking confirmation. Where online payment is selected, the amount shown is due when booking; where payment on site is agreed, it is due no later than when the service is provided or the equipment is collected. Additional charges arising later, in particular for an agreed extension or late return, are due no later than upon return. Payments already made will be credited.

Lockers are charged at the fixed prices shown during booking; discounts on equipment rental apply to lockers only if expressly stated. If a locker is reserved without advance payment, the price shown remains payable under the confirmed payment terms. The booked locker location is stated in the booking confirmation.

For online bookings, unless the booking confirmation states otherwise, rented equipment may be collected without extra charge from 1:00 PM on the day before the first rental day and returned without extra charge until 11:00 AM on the day following the final booked rental day. Otherwise, the collection and return times in the booking confirmation apply. Each additional rental day commenced due to late return is charged at the applicable rental rate.

    10. EQUIPMENT NOT RETURNED ON TIME
If rented equipment is not returned on time, K&K Sports may charge for additional rental days. If, despite a request and a reasonable additional period, neither the equipment is returned nor contact is made, K&K Sports may assess the specific circumstances, file a report where appropriate and claim documented loss and necessary costs subject to the applicable legal requirements. A theft report is not filed automatically after a set number of days.

    11. EARLY RETURN
In the case of a voluntary early return, there is generally no entitlement to a refund of the agreed rental fee. A partial refund may be granted only in the event of illness or accident and upon presentation of a medical confirmation. The confirmation only needs to state that the rented equipment could not be used during the relevant period; diagnosis details are not required. Any refund is calculated from the date on which the equipment is actually returned.

    12. SKI BINDING ADJUSTMENT AND ACCURACY OF INFORMATION
The renter confirms that all information provided, in particular height, weight, age, skiing ability and ski boot sole length, is complete and correct. The renter agrees that the ski binding may be professionally adjusted on the basis of this information, the manufacturer’s instructions and recognised technical rules. Incorrect information or subsequent changes must be reported to K&K Sports immediately.

    13. CANCELLATIONS, BOOKING CHANGES AND SPORTEASY CANCELLATION PROTECTION
Without the optional paid SportEasy Cancellation Protection, no additional contractual right to free cancellation or free booking changes is granted. Any charges or refunds following cancellation are determined under applicable law, taking into account, in particular, costs saved and any rental of the equipment to other customers. Simply not using the booked equipment does not automatically make the full rental price payable.

If SportEasy was expressly selected when booking, the equipment booking may be cancelled without cancellation charges up to three days before the agreed rental start date. Rental fees already paid will be refunded without undue delay using the original payment method. The SportEasy fee itself is non-refundable.

SportEasy also allows booking changes without an administration fee up to three days before the rental start date. Any price differences, for example for additional rental days or a different equipment category, will be charged or refunded accordingly. Changes are subject to availability.

Cancellation and change requests must be emailed to info@kandk.bz, quoting the booking number. The request must be received by the applicable deadline. After this deadline, SportEasy provides no additional right to free cancellation or free booking changes.

SportEasy applies to the booked rental equipment. Locker bookings may still be cancelled free of charge until the booked use begins, provided access has not already been handed over or activated.

After equipment handover, section 11 on early return applies. Mandatory statutory rights, particularly in the event of non-performance, remain unaffected.

    14. AVAILABILITY OF RESERVED EQUIPMENT
Unless expressly confirmed otherwise, the reservation relates to the selected equipment category and not to a specific model. The specific model is selected on site and depends on availability.

K&K Sports may provide an equivalent or higher-category replacement model at no extra charge. If no suitable equivalent equipment can be provided, the customer may withdraw from the affected service and will receive a refund of any payments already made for that service.

    15. INSPECTION UPON COLLECTION
The renter should check the equipment upon collection for completeness, correct size or adjustment and visible damage and inform K&K Sports of any discrepancies without delay. By accepting it, the renter confirms its condition insofar as this is apparent on an ordinary inspection, except for documented signs of use or damage. Rights concerning hidden defects and K&K Sports’ statutory liability remain unaffected.

    16. PERSONAL USE AND TRANSFER
The rented equipment may only be used by the person specified in the rental agreement. Transfer to third parties is not permitted without the express consent of K&K Sports.

    17. SAFE USE AND LIABILITY
The renter must use the equipment in accordance with their personal ability, the prevailing conditions and the applicable safety rules.

K&K Sports is not liable for damage or injury caused solely by improper use, incorrect information, incorrect self-assessment, failure to observe safety rules or other conduct of the renter.

Any mandatory statutory liability of K&K Sports remains unaffected, in particular in cases of intentional or grossly negligent conduct, personal injury and defective or improperly maintained rental equipment.

    18. CHANGES TO THE RENTAL PERIOD
An extension is possible only after prior consultation with K&K Sports and subject to availability. The additional rental fee must be paid no later than upon return. A shortening of the rental period generally does not entitle the renter to a refund, except in the cases set out in section 11.

    19. APPLICABLE LAW AND JURISDICTION
Italian law applies. Mandatory statutory rules on jurisdiction apply to consumers. For contracts with businesses, Bolzano is agreed as the place of jurisdiction to the extent permitted by law.

    20. ONLINE BOOKING, CONCLUSION OF CONTRACT AND BOOKING CONFIRMATION
The essential characteristics of the services, booked location, rental or usage period, total price including selected extras and payment terms are shown in the booking summary before the order is placed and recorded in the booking confirmation. Any legally required information on whether a statutory right of withdrawal exists or an exception applies must be supplied separately for the service booked before the contract is concluded.

The contract is concluded when K&K Sports issues the booking confirmation. The confirmation and these terms are provided to the customer by e-mail or another durable medium.

When booking for minors, the person making the booking confirms that they are authorised to do so and that the required details are correct and complete.
